PROBATE COURT
To Antone Lopes and John Lopes both of Fairhaven, in the County of Bristol, and to all persons interested in the Estates of Joseph R. Nunes, Mary E. Raphael, Frank R. Nunes, Domingo Nunes, Marion Nunes and James A. Nunes. and to all other persons interested.
A petition has been presented to said Court by Robert J. Souza of Mattapoisett in the County of Plymouth, representing that he holds as tenant in common an undivided part or share of certain land lying in Mattapoisett in said County of Plymouth and briefly described as follows: Three certain lots of woodlands in Mattapoisett located between the King Philip Spring Road, so called, and the road now leading to the Fin Fur and Feather Club, being lots numbers 2, 3, and 4 in the survey for the division of Harvey Dexter land so called, making one continuous parcel, containing eleven (11) acres more or less and the Courses herein given being from deeds of about 1861:
Beginning at the southeast corner thereof at the northeast corner of lot #5 now or formerly owned by William H. Dexter at a stone post; thence in line of land now or formerly of J. Leonard Randall
North·12 1/3° West -- fifty-six (56) rods thirteen (13) feet to a large white oak tree at the northwest corner of said Randall land and northeast corner of lot #2 and in line of land of a former grantor of this land; thence in line thereof
West 3° North -- twenty-nine (29) rods fourteen (14) feet to a stone post or a stake and stones in line of land now or formerly owned or occupied by the Fin, Fur & Feather Club; thence in line thereof
South 1° West -- fifteen (15) rods seven (7) feet to a stake and stones; thence in line of the stone wall about west seven (7) rods to an angle in the wall; thence
South 15 ½°East-- in line of the stone wall eighteen (18) rods more or less to an angle in the wall; thence a short distance southerly and easterly in line of the stone wall to an angle in the wall; thence
South 8 ½°East-- in line of the stone wall twenty-nine (29) rods to an angle in the wall at the northwest corner of said lot #5, now or formerly of William H. Dexter; thence in line of that last-named land
East 12 1/3° North – thirty-three (33) rods four (4) feet to the place of beginning.
setting forth that he desires that all of said land may be sold at private sale for not less than $25,000.00 dollars and praying that the partition may be made of all the land aforesaid according to law, and that a commissioner be appointed to make such partition and be ordered to make sale and conveyance of all, or any part of said land which the Court finds cannot be advantageously divided at private sale and be ordered to
distribute the net proceeds thereof.
If you desire to object thereto you or your attorney should file a written appearance in said Court at Plymouth before ten o’clock in the forenoon on the seventeenth day of February 2026 the return day of this citation.
