Wareham man arrested in Marion on several gun, drug charges
MARION — A Wareham man was arrested in Marion Saturday, Oct. 4 on gun, drug and operating under the influence charges.
Brian M. Ewan, 67, of Wareham was arrested at Cumberland Farms in Marion after Marion Police responded to a report of a man passed out in a vehicle.
According to Marion Police, Officer Patrick Adams found a man, identified as Ewan, in the driver’s seat of the vehicle with keys in the ignition and several open alcohol containers in plain view at approximately 3:34 p.m.
Adams was joined by Marion Detective Scott Smith in the investigation.
According to Smith, Ewan denied that he was asleep and had been drinking, he claimed he was looking at a scratch-off ticket. Ewan said he was visiting a friend in the area.
"I've been tormented enough," Ewan told Smith and Adams, "Does anyone care about the rights of the American people?"
Smith noticed a bulge on Ewan’s waistband consistent with a firearm. As Smith attempted to search Ewan, a struggle ensued.
Smith was able to gain control of Ewan and his Taurus G3C 9mm handgun with eight rounds of ammunition loaded inside.
Sargent Cardoso of the Marion Police Department informed Smith that Ewan's License to Carry, the permit required to purchase, possess and transport most firearms, had expired in 2000.
Adams continued to search the vehicle and found loose .22 caliber bullets on Ewan’s person and a clear bag containing a white powdery substance later positively identified as cocaine.
Another Marion Police officer found a sawed-off Mossberg 12-gauge shotgun with no ammunition. A shotgun with a barrel length that is less than 18 inches Massachusetts is considered sawed-off— Ewan's was just over 14-and-a-half inches long.
Police also found an opened 75 liter bottle of Jack Dainels, a 375 milliliter container of Jack Dainels and a can of Pabst Blue Ribbon beer.
Ewan was arraigned and charged Monday, Oct. 6 with possession of a firearm without a firearms identification card, possession of ammunition without a firearms identification card, carrying a firearm without a license, possession of a sawed-off shotgun, possession of a Class B drug, operating under the influence of liquor, possession of an open container of alcohol in a motor vehicle and no inspection/sticker.
Ewan was also charged with possession of a large-capacity feeding device, or, a magazine that can hold more than 10 rounds of ammunition.
This is not Ewan's first run-in with the law. He was arrested in 2020 after shooting another man in the face with a BB gun. He was found guilty in 2024 of; possession of dangerous weapon, assault and battery, possession of a firearm without a Firearms Identification Card and resisting arrest.
Ewan is on probation for the offenses until Dec. 19, 2025.
