Notice of Application
Notice is hereby given that the Massachusetts Department of Transportation, Rail and Transit Division, has filed a 401 Water Quality Certification application for the proposed culvert replacement and sheet pile retaining wall installation on the MassDOT- owned Cape Main Railroad at Mile Post 44.29, located approximately 500-feet south of the SEMASS recycling facility, Rochester, MA.
According to c. 79 § 24 of the (Massachusetts) Acts of 2014, the project qualifies for using the Footprint Bridge Exemption. As stated in the cited regulation, the “bridge” shall include any structure spanning and providing passage over water, railroad right-of-way, public or private way, other vehicular facility or other area”. As the culvert meets the definition of a bridge, the exemption is applicable and eliminates the need for the review under Massachusetts Environmental Policy Act, Wetlands Protection Act and Waterways Regulations (Chapter 91). The project plans may be reviewed at the Commission office at 16 Jan Sebastian Drive during regular business hours.
