To: Lezan M. Hodge of Rochester, in the County of Plymouth, and to all other persons interested.

A petition has been presented to said Court by Matthew J. Gwozdz of Rochester, in the County of Plymouth, representing that he holds as joint tenants an undivided part or share of certain land lying in Rochester, in said County and briefly described as follows:

The land in Rochester, Plymouth County, Massachusetts, with any buildings thereon, bounded as follows;

That certain tract or parcel of land with all the buildings and improvements thereon, located on Pine Street, in the Town of Rochester, County of Plymouth, Commonwealth of Massachusetts, laid out and designated as recorded Lot No, 40 B on that plat entitled “Subdivision of Land” in Rochester, MA, prepared for William & Gail Post, Scale: 1’=40’, Date: October 25, 1994, G.A.F. Engineering Inc. Professional Engineers & Land Surveyors, 454 Wareham Street, P.O. Box 953 Marion, MA 02738, which plat is recorded in the Plymouth County Register of Deeds Plan Book 38 at Page No. 22.

Said Parcel is bounded on the southeast by land now or lately of George A. Kirby, III on the northeast by land now or lately of Arthur E. Bassett et als; on the northwest by Pecan Tree Drive; and on the southwest by Pine Street.

Being the same premises conveyed to these Grantor’s by deed recorded with the Plymouth County Register of Deeds in Book 51700, Page 122.

setting forth that he desires that all of said land may be sold at private sale for not less than $600,000.00 dollars and praying that partition may be made of all the land aforesaid according to law, and to that end that a commissioner be appointed to make such partition and be ordered to make sale and conveyance of all, or any part of said land which the Court finds cannot be advantageously divided either at private sale or public auction, and be ordered to distribute the net proceeds thereof.

If you desire to object thereto you or your attorney should file a written appearance in said Court at Plymouth before ten o’clock in the forenoon on the fourteenth day of November, 2022, the return day of this citation.
