Mattapoisett, Coalition file for contempt of court on wetlands case

MATTAPOISETT — Working together, Mattapoisett and the Buzzards Bay Coalition have filed a complaint for contempt in Plymouth County Superior Court to compel Daniel Craig to restore a half acre of damaged wetlands and protected buffer zone areas he illegally filled at least five years ago.

When Seabreeze Lane, where Craig lives, was developed in 2000, efforts were made to mitigate construction impacts on the pond’s health and habitats.

In 2015, Google Earth images revealed newly filled lawn and garden in areas that were previously wetlands or wetland buffer. The Buzzards Bay National Estuary Program did satellite image analysis to examine the extent of and timeline for these unauthorized alterations.

The Mattapoisett Conservation Commission requested that Craig meet to resolve the matter. However, after months of negotiations with the Commission, he withdrew. The commission with then issued an enforcement order to try to compel compliance with the law. Craig then sued the commission in court to keep the property as it was.

The Coalition, with 12 citizens from Mattapoisett, intervened in that lawsuit. The court ruled against the homeowner. Still refusing to comply, Craig appealed the Superior Court’s decision to the Appeals Court, which ruled again that his actions were illegal.

The Massachusetts Supreme Judicial Court refused to hear the homeowner’s case.
