Mattapoisett voters pass zoning amendments
The second time was the charm for three zoning bylaw amendments brought by the Planning Board.
Brad Saunders of D+E Management LLC brought the changes to the board. He represents a development company within the Bay Club, and Bay Club property owners.
All of the amendments concern cluster subdivisions – a subdivision with a larger open space area in exchange for smaller housing lots. The articles allow for the creation of duplexes, the use of limited industrial lands as open space and the development of cluster subdivisions in general business districts.
Saunders brought the amendments to fall Town Meeting, but they were essentially shot down on the floor by voters.
At Town Meeting on Tuesday, Saunders again explained the amendments.
One resident asked how many cluster subdivisions are in the town. With only one, the Bay Club, Bill Cantor asked, “Why are we being asked to change the zoning when this article appears to be basically for the benefit of one particular applicant and one particular property?”
He also asked why the Bay Club couldn’t apply for special permits and variances. Town Counsel said that would count as spot zoning, which is illegal.
Regarding the zero lot line change, which would allow for duplexes in 20 percent of the development, Highway Surveyor Barry Denham pointed out that the Bay Club could not increase housing.
Saunders said the amendment would allow for more flexibility for anyone with the required eight acres who wanted to build a cluster subdivision.
Developer Doug Schneider voiced support for the changes.
“It’s a benefit for the town. It’s a benefit for the developer. It’s a good thing.”
Voters approved all three amendments.
