Barking dogs prompt public hearing in Rochester

Noise complaints leveled against a kennel owner were dropped on Monday after neighbors told Rochester Selectmen the problem had been resolved.

Based on police reports, dogs at Liberal Teixeira’s kennel on North Avenue were barking as late as 1 a.m. on some nights and as early as 6 a.m. in the morning.

Selectmen told Teixeira about the hearing through certified mail on Sept. 6. In the spring, abutters and neighbors filed complaints with Rochester Animal Control Officer Anne Estabrook, who was also present at the hearing.  Estabrook noted the dogs’ continuos barking created a “nuisance” for neighbors and violated Massachusetts state law. Texieria’s neighbor Donna Medeiros filed complaints with police in the spring and summer.

“I’m generally home at night to sleep. I work during the day. I don’t want to hear those dogs after eleven o’clock at night,” she said, adding she would call police after the barking had become a nuisance. “I’m not calling after five minutes. I’m calling after forty-five minutes of them barking.”

Teixeira said at the time he had four or five beagles, which sounded off on a regular basis. He has since found foster homes for the animals.

That seemed to solve the problem, he said. “It’s a lot quieter with those beagles gone,” Teixeira said. “They were annoying me at some points. To me, things seem to be a lot better.”

Medeiros agreed. “If everything is the way it is now, I’ll be very happy,” she said.

Teixeira said he made efforts to solve the problem when he became aware of the constant barking.  “I’m going to do things to improve the situation,” he said. “I don’t want to make my neighbors mad.”

Teixeira is licensed to operate a 16-dog kennel. He generally breeds dogs that are a mix of Labrador retrievers and poodles; golden retrievers and poodles; and pure bred golden retrievers.

On the advice of Town Counsel Blair Bailey, Selectmen continued the hearing to January. If no additional complaints surface before then, Selectmen said the hearing will not be held.

In the meantime, Teixeira noted he was willing to work with the town and his neighbors.  “I’ll definitely try to keep them as quiet as I can. If there’s a problem please tell me and I’ll address the issue,” Teixeira said.
