A petition has been presented to said Court by Megan K. Blevins of Lehigh Acres, FL 33971, representing that she holds as tenant in common an undivided part or share of certain land lying in Rochester, in said County of Plymouth and briefly described as follows:

Those certain tracts or parcels of land with the buildings and improvements thereon, if any, situated on the northerly side of Mendell Road, off the easterly side of Neck Road, on the westerly side of Sarah Sherman Road and the southwesterly side of Alley Road in Town of Rochester, County of Plymouth, and Commonwealth of Massachusetts, being shown and delineated as:

Cass, S.I.T., Stephen T.Gilbert,R.L.S.,” which is recorded in the PlymouthCounty Registry of Deeds as Plan No. 00-156 at Plan Book 43, Page 233.

TRACT TWO:

That certain parcel of land with the buildings and improvements thereon, if any, situated on the northerly side of Mendell Road in the Town of Rochester, County of Plymouth, and Commonwealth of Massachusetts, being shown as Lot 8G-REV on a plan entitled “Rochester, MA prepared for Edward P. Ashley William S. Souza”, dated May 3, 2004, Scale 1” = 200’, prepared by Geodetic Engineering Inc., and recorded with the Plymouth County Registry of Deeds as Plan No. 80 of 2005 in Plan Book 49, Page 392. Said Lot 8G-REV containing 112.54 acres, more or less, according to said plan.

TRACT THREE:

That certain parcel of land with the buildings and improvements thereon, if any, situated on the easterly side of Sarah Sherman Road in the Town of Rochester, County of Plymouth, and Commonwealth of Massachusetts, being shown as Lot1E-1 on a plan entitled “Plan of Land in Rochester, MA prepared for Karl J. Ashley III Edward P. Ashley Sherman Bogs”, dated April 23, 2003, Scale 1” = 100’, prepared by Geodetic Engineering Inc., and recorded with the Plymouth County Registry of Deeds as Plan No. 358 of 2003 in Plan Book 46, Page 1002. Said Lot 1E-1 containing 19,933.91 sq. feet or 0.46 acres, more or less, according to said plan.

Together with an easement referenced in the deed of Willard A. Rhodes Trustee of Edgewood Trust, to Noble Foss dated September 16, 1964 and recorded in the Plymouth County Registry of Deeds at Book 3143, page 381.

Together with an easement given by Maxwell M. Lawrence, Jr. and Polly P. Lawrence to Edgewood Trust dated July 26,1985 and recorded in the Plymouth County Registry of Deeds at Book 6220, Page 298.

Subject to and with the benefit of the reservations and covenants contained in the deed of William A Rhodes, Trustee, to Evans J. Flynn recorded in the Plymouth County Registry of Deeds at Book 3286, Page 216.

Subject to the existing easement to the New Bedford Gas & Edison Light Company recorded in the Plymouth County Registry of Deeds at Book 2848, Pages 21 and 22.

Subject to an easement to the New Bedford Gas & Edison Light Company recorded in the Plymouth County Registry of Deeds at Book 1749, Page 71.

Map 28, Lot 8D is subject to a restriction that no house or building shall be erected on the premises as set forth in deed of Gibbs V. Bray to Edward P. Ashley dated December 9, 1985 and recorded in the Plymouth County Registry of Deeds at Book 6543, Page 74, said restrictions to remain in effect for a period of thirty years (30) year from the date of said deed.

praying that partition may be made of all the land aforesaid according to law, and to that end that a commissioner be appointed to make such partition and be ordered to make sale and conveyance of all, or any part of said land which the Court finds cannot be advantageously divided at public auction, and be ordered to distribute the net proceeds thereof.
