By virtue and in execution of the Power of Sale contained in a certain mortgage given by Nathan J. Dvorski to Mortgage Electronic Registration Systems, Inc., as Mortgagee, as nominee for RBS Citizens, N.A., and now held by Citizens Bank, N.A. f/k/a RBS Citizens N.A., said mortgage dated March 7, 2011 and recorded in the Plymouth County Registry of Deeds in Book 39727, Page 264, as affected by a Loan Modification Agreement dated December 22, 2017 and recorded in the Plymouth County Registry of Deeds in Book 49481, Page 303; said mortgage was assigned from Mortgage Electronic Registration Systems, Inc. as nominee for RBS Citizens, N.A. to Citizens Bank, N.A. f/k/a RBS Citizens, N.A. by assignment dated December 1, 2015 and recorded with said Registry of Deeds in Book 46356, Page 286; for breach of the conditions in said mortgage and for the purpose of foreclosing the same will be sold at Public Auction on February 7, 2023 at 02:00 PM Local Time upon the premises, all and singular the premises described in said mortgage, to wit:

The land referred to in this document is situated in the STATE OF MASSACHUSETTS, COUNTY OF PLYMOUTH, CITY OF ROCHESTER, and described as follows:

Beginning at a stake at the Northeasterly line of Mendall Road and at the Southwesterly corner of land now or formerly of George Cowen;

Thence NORTH 22° 5’ 35” east, two hundred and no /100 (200.00) feet to a stake at the other land of George A. Cowen;

Thence NORTH 59° 03’ 25” west, one hundred twenty-five and no/100 (125.00) feet;

Thence SOUTH 22° 05› 35» WEST, two hundred and no/100 (200.00) feet to the Northwesterly line of Mendall Road; and

Thence SOUTH 59° 03’ 25” EAST, one hundred twenty-five and no/100 (125.00) feet to the point of beginning.

Being the same property conveyed to Nathan J. Dvorski from Glenn R. Lawrence A/K/A Glen R. Lawrence and Laurie Whitney-Lawrence by deed dated 03/02/2011 and recorded on 03/08/2011 in the Register of Deed for PLYMOUTH County, Massachusetts in Deed Instrument 2011 00019666 Deed Book 29727, Page 262

The description of the property contained in the mortgage shall control in the event of a typographical error in this publication.

For Mortgagor’s Title see deed dated March 2, 2011 and recorded in the Plymouth County Registry of Deeds in Book 39727, Page 262.

TERMS OF SALE: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described.

FIVE THOUSAND ($5,000.00) Dollars of the purchase price must be paid in cash, certified check, bank treasurer’s or cashier’s check at the time and place of the sale by the purchaser. The balance of the purchase price shall be paid in cash, certified check, bank treasurer’s or cashier’s check within thirty (30) days after the date of sale.

has been informally appointed as the Personal Representative of the estate to serve without surety on the bond.

The estate is being administered under informal procedure by the Personal Representative under the Massachusetts Uniform Probate Code without supervision by the Court.
