and to all persons entitled to the benefit of the Servicemembers Civil Relief Act, 50 U.S.C. c. 50 §3901 (et seq):

Reverse Mortgage Funding, LLC

claiming to have an interest in a Mortgage covering real property in Rochester, numbered 338 North Avenue, given by Lydia B Dias to Financial Freedom Senior Funding Corporation, A Subsidiary of Indy Mac Bank, F.S.B., dated July 24, 2006, and recorded in the Plymouth County Registry of Deeds in Book 33099, Page 86 and now held by Plaintiff by assignment, has/have filed with this court a complaint for determination of Defendant’s/Defendants’ Servicemembers status.

If you now are, or recently have been, in the active military service of the United States of America, then you may be entitled to the benefits of the Servicemembers Civil Relief Act. If you object to a foreclosure of the above-mentioned property on that basis, then you or your attorney must file a written appearance and answer in this court at Three Pemberton Square, Boston, MA 02108 on or before 5/2/2022 or you may lose the opportunity to challenge the foreclosure on the ground of noncompliance with the Act.

By virtue and in execution of the Power of Sale contained in a certain mortgage given by Jana G. Cavanaugh to Mortgage Electronic Registration Systems, Inc., as nominee for Residential Mortgage Services, Inc., dated July 13, 2012 and recorded in the Plymouth County Registry of Deeds in Book 41667, Page 64 of which mortgage the undersigned is the present holder, by assignment from:

Beginning at the northwest corner of the land herein described at a point in the easterly line of Walnut Plain Road, and at the southwest corner of Lot #12 as shown on plan of land hereinafter mentioned; thence North 65 deg 30’ 00” East in line of last named lot, two hundred forty and 83/ ) feet to Lot # 13 as shown on said plan, thence South 21 deg 00’ 30” in line of last named lot, two hundred and 37/100 feet (200.37) feet to Lot # 10 as shown on said plan, thence South 65 deg 30’ 00” West in line of last named lot, two hundred fifty two and 03/100 (252.03) feet to a point; thence Northwesterly in the arc of a curve having a radius of two thousand and seven hundred ninety seven and 967/1000 (2,797.967) feet, a distance of seventy seven and 77/100 977.77) feet to a point in the said line of Walnut Plain Road, and thence North 17 deg 31’ 00” West in line of said Walnut Plain Road, one hundred twenty three and 61/100 (123.61) feet to the point of beginning. Containing 49,367 square feet, more or less. Being shown as Lot # 11 on Plan of Land in Rochester, Mass, surveyed for Winfred A. and Virginia B. Blais, dated May 18, 1976 and revised May 20, 1976, Arthur C. Thompson, Inc., Engineers and Surveyors, filed with Plymouth County Registry of Deeds in Plan Book 18, Page 1088.

These premises will be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed.

TERMS OF SALE:

A deposit of Five Thousand ($5,000.00) Dollars by certified or bank check will be required to be paid by the purchaser at the time and place of sale. The balance is to be paid by certified or bank check at Harmon Law Offices, P.C., 150 California St., Newton, Massachusetts 02458, or by mail to P.O.
