a Will has been admitted to informal probate.

Diane Clancy Ulianelli of Rochester, MA,

has been informally appointed as the Personal Representative of the estate to serve without surety on the bond.

The estate is being administered under informal procedure by the Personal Representative under the Massachusetts Uniform Probate Code without supervision by the Court. Inventory and accounts are not required to be filed with the Court, but interested parties are entitled to notice regarding the administration from the Personal Representative and can petition the Court in any matter relating to the estate, including distribution of assets and expenses of administration. Interested parties are entitled to petition the Court to institute formal proceedings and to obtain orders terminating or restricting the powers of Personal Representatives appointed under informal procedure. SALE OF REAL ESTATE

By virtue and in execution of the Power of Sale contained in a certain mortgage given by Janice Pavao to Mortgage Electronic Registration Systems, Inc., as nominee for Eastern Bank, dated January 6, 2011 and recorded in the Plymouth County Registry of Deeds in Book 39543, Page 181, of which mortgage the undersigned is the present holder, by assignment from:

for breach of the conditions of said mortgage and for the purpose of foreclosing, the same will be sold at Public Auction at 3:00 PM on May 16, 2023, on the mortgaged premises located at 445 County Road, Rochester, Plymouth County, Massachusetts, all and singular the premises described in said mortgage,

TO WIT:
the land in said Rochester, with the buildings thereon, bounded and described as follows: Beginning at a stake on the westerly side of Briggs Lane, also called County Road, which stake marks the boundary between the premises hereinafter described and land now or formerly of George P. Morse; Thence in line of land now or formerly of George P. Morse and also to land now or formerly of one Govoni, westerly to a stake and stones, an ancient corner; Thence southerly in line of land now or formerly of said Govoni to a sake and stones, another ancient corner; Thence southeasterly in line of land now or formerly of one Gault to a stake and stones; Thence northeasterly in line of land now or formerly of one Cowen to a stake and stones; Thence easterly in line of land now or formerly of said Cowen to a stake and stones to line of land now or formerly of George P. Morse; Thence northerly in line of land now or formerly of George P. Morse and in line of land now or formerly owned by William P. Cobb and nearly parallel to said Briggs lane also known as County Road, to a stake and stones in line of land of said Cobb; Thence in line of land of said Cobb easterly to a stake and stones on the westerly side of said Briggs lane also know as County Road; Thence by said Briggs Lane, also know as County Road, northerly to the bound first mentioned. Excepting therefrom the premises conveyed by Josephine P. Holway to Joseph Florindo dated February 11, 1959 and recorded in Plymouth County Registry of Deeds Book 2737 Page 183 more particularly described as follows: The land in Rochester Plymouth County, Massachusetts, situated westerly of County Road and adjacent to other land of Joseph Florindo bounded and described as follows: Beginning at a concrete bound (at the) northeasterly corner of the lot to be described at a point in line of other land of Joseph Florindo, said bound situated south 78° 14’ 00” west, eight hundred seventy-one and 24/100 (871.24) feet from a stone bound situated in or near the westerly line of County Road and marking the northeasterly corner of the homestead of Josephine Holway; Thence running in line of remaining land of Josephine P. Holway south 15°01’ 40”east, two hundred fifty-three and 39/100 (253.39) feet to a concrete bound for a corner; Thence turning and running in line of land now or formerly of Ernest H. Sherman et al, north 89°56’20” west, five hundred ninety-four and 26/100 (594.26) feet to an iron pipe for a corner; Thence turning and running southwesterly in line of land now or formerly of Ernest H. Sherman et al, four hundred forty and 8/100 (440.8) feet or or less to the “Old Claghorn Line”’ Thence turning and running in the “Old Claghorn Line” so called northwesterly one hundred fifty-nine and 7/10 (159.7) feet more or less to other land of Joseph Florindo; Thence turning and running in line of other land of Joseph Florindo northeasterly two hundred twenty-seven and 5/10 (227.5) feet more or less to a point for a corner; Thence turning and running easterly in line of other land of Joseph Florindo, eight hundred sixty-­eight and 95/100 (868.95) feet more or less to the center line of the north edge of a stone bound; Thence continuing in line of other land of Joseph Florindo north 78°14’ 00” east, thirty and 21/100 (30.21) feet to the concrete bound first mentioned and point of beginning. The above described premises are shown as Lot “A” on “Plan of Land, surveyed for Josephine P. Holway, Rochester, Mass. Scale 1”= 100’ January 22, 1959, Walter E. Rowley, Surveyor, West Wareham, Massachusetts. The land being conveyed hereunder contains 3.45 acres of land more or less.

For mortgagor’s(s’) title see deed recorded with Plymouth County Registry of Deeds in Book 4334, Page 218.

These premises will be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed.

TERMS OF SALE:
A deposit of Five Thousand ($5,000.00) Dollars by certified or bank check will be required to be paid by the purchaser at the time and place of sale. The balance is to be paid by certified or bank check at Harmon Law Offices, P.C., 150 California St., Newton, Massachusetts 02458, or by mail to P.O. Box 610389, Newton Highlands, Massachusetts 02461-0389, within thirty (30) days from the date of sale. Deed will be provided to purchaser for recording upon receipt in full of the purchase price. The description of the premises contained in said mortgage shall control in the event of an error in this publication.
