MORTGAGEE’S SALE OF REAL ESTATE

By virtue of and in execution of the Power of Sale contained in a certain mortgage given by Gilbert Leonardo and Donna Leonardo to Mortgage Electronic Registration Systems, Inc., as mortgagee, acting solely as a nominee for MetLife Home Loans, a Division of MetLife Bank, N.A., dated April 27, 2009 and recorded in Plymouth County Registry of Deeds in Book 37142, Page 289 (the “Mortgage”), as affected by a Loan Modification dated September 5, 2012, and recorded at said Registry of Deeds in Book 42504, Page 118 of which mortgage Lakeview Loan Servicing, LLC is the present holder by Assignment from Mortgage Electronic Registration Systems, Inc. solely as nominee for Metlife Home Loans, a division of Metlife Bank, N.A. its successors and assigns to MetLife Home Loans, a Division of MetLife Bank, N.A. dated November 29, 2011 and recorded at said Registry of Deeds in Book 40725, Page 295, and Assignment from MetLife Bank, National Association also known as MetLife Home Loans, a division of MetLife Bank, N.A. to JPMorgan Chase Bank, National Association dated October 21, 2013 and recorded at said Registry of Deeds in Book 43750, Page 204, and Assignment from JPMorgan Chase Bank, National Association to Lakeview Loan Servicing, LLC dated December 14, 2018 and recorded at said Registry of Deeds in Book 50644, Page 154, and Assignment from MetLife Home Loans, LLC sbm to MetLife Home Loans, a division of MetLife Bank, N.A. to Lakeview Loan Servicing, LLC dated August 11, 2022 and recorded at said Registry of Deeds in Book 57136, Page 17, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 1121 Point Road, Marion, MA 02738 will be sold at a Public Auction at 10:00 AM on December 20, 2022, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit:

That certain parcel of land with the buildings and improvements thereon situated in the Town of Marion, County of Plymouth, Commonwealth of Massachusetts more commonly described as follows:

BEGINNING in the northerly line of Point Road at the southeasterly corner of the premises to be described;

thence NORTH 81 degrees 35’ 14” west by the northerly line of the said Point Road 100.00 feet;
thence NORTH 8 degrees 24’ 46” east by land of this grantor, being shown as Lot #10 on a plan hereinafter mentioned 200.00 feet;
thence SOUTH 81 degrees 35’ 14” east by the said last named land 125.00 feet to the westerly line of a way known as Sherman’s Way;
thence SOUTH 8 degrees 24’ 46” west by the westerly line of the said Shermans Way 175.00;
thence SOUTHERLY, southwesterly and westerly by the said Shermans Way by a curve deflecting to the right, said curve having a radius of 25.00 feet and a length of 39.27 feet measured on the arc to the point of beginning.

CONTAINING 24,865 square feet more or less.

The above described premises being shown as lot #11 on a plan entitled “Plan of Land in Marion, MA., prepared for Sherman E. Briggs, JR., April 3, 1987, Scale: 1” = 60’, Arthur C. Thompson, Inc. Engineers & Surveyors, Marion, MA.”

Being the same premises conveyed to these mortgagors by deed of Sherman E. Briggs, Jr. dated January 21, 1994 and recorded with the Plymouth County Registry of Deeds in Book 12614, Page 12.

The premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, and subject to prior liens or other enforceable encumbrances of record entitled to precedence over this mortgage, and subject to and with the benefit of all easements, restrictions, reservations and conditions of record and subject to all tenancies and/or rights of parties in possession.

Terms of the Sale: Cashier’s or certified check in the sum of $5,000.00 as a deposit must be shown at the time and place of the sale in order to qualify as a bidder (the mortgage holder and its designee(s) are exempt from this requirement); high bidder to sign written Memorandum of Sale upon acceptance of bid; balance of purchase price payable by certified check in thirty (30) days from the date of the sale at the offices of mortgagee’s attorney, Korde & Associates, P.C., 900 Chelmsford Street, Suite 3102, Lowell, MA or such other time as may be designated by mortgagee. The description for the premises contained in said mortgage shall control in the event of a typographical error in this publication.
