By virtue and in execution of the Power of Sale contained in a certain Mortgage given by Joseph Hefner and Linda Camara to Mortgage Electronic Registration Systems, Inc., as nominee for LoanDepot.com, LLC, its successors and assigns, dated April 7, 2017 and recorded with the Plymouth County Registry of Deeds at Book 48304, Page 49, as affected by Affidavit recorded in Said Registry of Deeds at Book 58477, Page 33, as affected by a Loan Modification recorded on May 12, 2022 in Said Registry of Deeds at Book 56797, Page 87, subsequently assigned to MidFirst Bank, A Federally Chartered Savings Association by Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for LOANDEPOT.COM, LLC, its successors and assigns by assignment recorded in said Plymouth County Registry of Deeds at Book 54462, Page 326 for breach of the conditions of said Mortgage and for the purpose of foreclosing same will be sold at Public Auction at 11:00 AM on August 1, 2024 at 4 Tallman Street, Mattapoisett, MA, all and singular the premises described in said Mortgage, to wit:

A certain portion of property bounded and described as follows: Beginning at a point in the easterly side of Tallman Street; Thence north 9° 26” 30’ west a distance of 57.21 feet along said easterly side of said Tallman Street to a point; Thence continuing north 9° 26” 30’ west a distance of 198.98 feet along said easterly side of Tallman Street more to a point; Thence north 47° 40” 43’ east a distance of 46.19 feet to a point; Thence north 83° 28” 50’ east a distance of 105.04 feet to a point; Thence south 18° 59” 49’ east a distance of 71.17 feet to a point; Thence continuing south 18° 59” 49’ east a further distance of 111.14 feet more or less all along the westerly boundary of property now or formerly of Neimad Club Home Corp,; Thence south 36° 52” 41’ west a distance of 101.48 feet by land now or formerly of grantors to a point; Thence south 66° 02” 12’ west a distance of 103.90 feet to the point of beginning and being shown as Lots No. 1 and Lot No. 2 on Plan of Land in Mattapoisett, MA prepared for Joseph L. Battistelli and Shirley M. Battistelli, dated October 9, 1998, Thompson Surveying and Engineering, The., said plan being duly recorded in Plan Book 43 Page 520 and also including an easement over Lot 3 as shown on said plan consisting of approximately 3,520 square feet and entitled Driveway Easement for the benefit of said Lots 1 and 2 and burdening Lot 4 as shown on said plan in order to allow access to Tallman Street as shown on said plan.
Meaning and intending to describe the same premises conveyed by deed dated April 28, 2016 and recorded May 3, 2016 with Plymouth Registry of Deeds in Book 46880, Page 315.
The premises are to be sold subject to and with the benefit of all easements, restrictions, encroachments, building and zoning laws, liens, unpaid taxes, tax titles, water bills, municipal liens and assessments, rights of tenants and parties in possession, and attorney’s fees and costs.
TERMS OF SALE:
A deposit of TEN THOUSAND DOLLARS AND 00 CENTS ($10,000.00) in the form of a certified check, bank treasurer’s check or money order will be required to be delivered at or before the time the bid is offered. The successful bidder will be required to execute a Foreclosure Sale Agreement immediately after the close of the bidding. The balance of the purchase price shall be paid within thirty (30) days from the sale date in the form of a certified check, bank treasurer’s check or other check satisfactory to Mortgagee’s attorney. The Mortgagee reserves the right to bid at the sale, to reject any and all bids, to continue the sale and to amend the terms of the sale by written or oral announcement made before or during the foreclosure sale. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid. The purchaser shall have no further recourse against the Mortgagor, the Mortgagee or the Mortgagee’s attorney. The description of the premises contained in said mortgage shall control in the event of an error in this publication. TIME WILL BE OF THE ESSENCE.

has been informally appointed as the Personal Representative of the estate to serve without surety on the bond.
The estate is being administered under informal procedure by the Personal Representative under the Massachusetts Uniform Probate Code without supervision by the Court.
