MORTGAGEE’S SALE OF REAL ESTATE

By virtue of and in execution of the Power of Sale contained in a certain mortgage given by Steven A. Briggs to Option One Mortgage Corporation, dated February 22, 2007 and recorded in Plymouth County Registry of Deeds in Book 34173, Page 340 (the “Mortgage”) of which mortgage Wells Fargo Bank, N.A., as Trustee for Soundview Home Loans Trust 2007-OPT1, Asset-Backed Certificates, Series 2007-OPT1 is the present holder by Assignment from Sand Canyon Corporation f/k/a Option One Mortgage Corporation to Wells Fargo Bank, N.A., as Trustee for Soundview Home Loans Trust 2007-OPT1, Asset-Backed Certificates, Series 2007-OPT1 dated January 6, 2011 and recorded at said Registry of Deeds in Book 39576, Page 192, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 1108 Point Road, Marion, MA 02738 will be sold at a Public Auction at 10:00 AM on June 12, 2024, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit:

The land together with any buildings thereon situated in Marion, Plymouth County, Massachusetts, and more fully bounded and described as follows:
Beginning at the northwesterly corner of the premises at a point in the southerly sideline of Point Road at land now or formerly of Anselmo Lopes et al, said point being Seventy-two and 13/100 (72.13) feet easterly of a Town of Marion highway bound in the southerly sideline of said Point Road; thence
SOUTH 81° 35’ 14” EAST by said Point Road one hundred thirty-eight and 45/100 (138.45) feet to other land of the grantor; thence
SOUTH 7° 47’ 36” WEST by said other land of the grantor Two hundred thirty-one and 49/100 (231.49) feet to land now of formerly of Dorothy Swift Handy et al; thence
SOUTH 80° 02’ 36” WEST by said land of Handy Seventy-five and 77/100 (75.77) feet to a stone bound; thence
NORTH 50° 45’ 15” WEST by said land of Handy One hundred forty-nine and 49/100 (149.49) feet to a stone bound at said land of Anselmo Lopes et al; thence
NORTH 71° 18’ 15” EAST b said Lopes land One hundred-sixty-three and 60/100 (163.60) feet to a corner, being the southeast corner of said Lopes land; thence
NORTH 31° 13’ 25” WEST by said Lopes land one hundred thirty-five and 29/100 (135.29) feet to the southerly sideline of Point Road and the point of beginning.
Containing 28,984 sq. ft. more or less and being shown on “Plan of Land in Marion, Mass., surveyed for Sherman E. Briggs, may 1971 Arthur C. Thompson, Inc. Engineers Marion, Mass.” being number 804 of 1971 plans recorded with Plymouth County Registry of Deeds in Plan Book 16, Page 101.
Being the same premises conveyed to me by deed dated March 11, 1987 recorded with the Plymouth County Registry of Deeds in Book 7543, Page 78; also deed dated May 23, 1987 recorded in Book 8231, Page 349; deed January 8, 1988 recorded in Book 8365, Page 289; and deed dated December 19, 1988 recorded in Book 9087, Page 132.

For mortgagor’s title see deed recorded with the Plymouth County Registry of Deeds in Book 7543, Page 78.

The premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, and subject to prior liens or other enforceable encumbrances of record entitled to precedence over this mortgage, and subject to and with the benefit of all easements, restrictions, reservations and conditions of record and subject to all tenancies and/or rights of parties in possession.

Terms of the Sale: Cashier’s or certified check in the sum of $5,000.00 as a deposit must be shown at the time and place of the sale in order to qualify as a bidder (the mortgage holder and its designee(s) are exempt from this requirement); high bidder to sign written Memorandum of Sale upon acceptance of bid; balance of purchase price payable by certified check in thirty (30) days from the date of the sale at the offices of mortgagee’s attorney, Korde & Associates, P.C., 900 Chelmsford Street, Suite 3102, Lowell, MA or such other time as may be designated by mortgagee. The description for the premises contained in said mortgage shall control in the event of a typographical error in this publication.
