Marijuana dispensary bylaw drafted

If approved, a proposed bylaw would allow medical marijuana facilities in Rochester but limit them to the adult entertainment district.

On Nov. 25, residents will be asked to vote on the bylaw at fall Town Meeting. Last November, Massachusetts voters passed a law that allows up to 35 dispensaries around the state to provide marijuana as treatment to patients with medical conditions.

The Planning Board had  previously asked for a moratorium on allowing the facilities in Rochester. Chair Arnie Johnson said state law prohibits towns from banning the facilities. In response, Johnson said the board drafted the bylaw to dictate where the dispensaries can operate.

The adult entertainment overlay district is located in Rochester’s industrial zone, found in the northern part of town near SEMASS.

Despite it’s racy title, no adult entertainment businesses currently operate in the district, Johnson said. Planning Board members met with members the Zoning Board of Appeals Tuesday night to discuss the bylaw.

Board of appeals Chair Rich Cutler said limiting the dispensaries to the overlay district was good planning. “If someone does develop a facility it’s nice to have it in a controlled area,” he said. “It makes sense to do that in the overlay district.”
