Marion ‘40B’ affordable housing developers look to start construction in July

The developers of a 96-unit affordable housing project are aiming to break ground in Marion in July, but first, they have some paperwork to square away.

On Thursday, the town’s Zoning Board of Appeals approved a performance guarantee agreement between the town and the developers, Bay Watch Realty. The agreement serves to ensure that Bay Watch Realty performs its obligations under contract.

The development would be constructed on Route 105 near the Wave Restaurant and Bar. It would include 60 apartments to be rented to tenants who meet income qualifications as well as 36 single-family homes for sale at market value.

The board approved the project last June. Since then, the developers have been working on finishing up some final paperwork with the state, said Bay Watch Realty representative Ken Steen.

Bay Watch Realty is seeking to build the housing development under the state’s “40B” affordable housing law. This would allow the developers to avoid local zoning restrictions if a number of housing units are sold or rented at below-market value to people who meet the income requirements.

Of the process, Steen said, “There’s monumental paperwork to get through.”
