Rochester man sentenced for shooting death
ROCHESTER — A Rochester man was sentenced to 8 to 10 years in state prison Friday, March 14 after being found guilty of criminal charges related to the 2023 shooting death of his sister’s boyfriend, according to the Plymouth County District Attorney’s office.
Cody Perry, 36, was convicted in Plymouth County Superior Court on March 12 of voluntary manslaughter and assault and battery with a deadly weapon causing serious bodily injury for the fatal shooting of 41-year-old Justin Doberck.
On the night of April 7, 2023, Rochester Police officers and Massachusetts State Police Troopers responded to reports of a shooting at 259 New Bedford Road.
Once on scene, law enforcement located a male victim — later identified as Doberck — who was transported to an area hospital in New Bedford where he was pronounced dead.
Through witness interviews and preliminary investigation law enforcement determined there had been a disagreement between Cody Perry and the victim following a night out together at a bonfire in the woods behind the New Bedford Road property. The incident escalated once Perry retrieved a firearm from the home and shot Doberck.
Officers subsequently arrested Perry without further incident.
The Commonwealth requested a period of incarceration of 18 to 20 years in state prison at a sentencing hearing on March 12.
Assistant District Attorneys Daniel Higgins and Jessica Croker prosecuted this case. It was investigated by Rochester Police and the Massachusetts State Police Detective Unit assigned to the Plymouth County District Attorney’s Office.
