Mattapoisett Planning Board presents draft medical marijuana bylaw

MATTAPOISETT - The Mattapoisett Planning Board have drafted a medical marijuana bylaw that would contain establishments to the limited industry zoning district.

Town Planner Mary Crain presented the draft bylaw to the Board of Selectmen at Tuesday night’s meeting.

In accordance with the drafted bylaw, a medical marijuana treatment center will not be allowed within 500 feet from a public or private school, a state-licensed child care center, a library, playground, public park, public beach, religious facility, youth center or any “similar facility in which minors commonly congregate.”

Additionally, cultivation and processing facilities located within the marijuana overlay district must be separated from adjacent property lines by a 50-foot buffer strip, unless the applicant can prove that adequate buffering can be provided within a narrower area.

Treatment facilities will only be allowed to be located in a permanent building, and not within any mobile facility.

The site plan and special permit requirements must include a security plan that details all security measures for the site and transportation of marijuana and marijuana products to and from off-site premises to “ensure the safety of employees and the public” and to protect the site from theft or other criminal activity.

Hours of operation for any medical marijuana facility treatment centers will be limited to 7 a.m.-7 p.m. No marijuana or marijuana products will be allowed to be smoked, eaten or otherwise consumed in public or on the site of the treatment facility.

Residents voted to prohibit recreational marijuana facilities at Town Meeting, and the medical marijuana bylaw will be voted on at the November Town Meeting.
